The following terms and conditions govern all use of the Junk Car Boys Website and Service included all content. JunkCarBoys.com (the "website"). The Website is owned and operated by Two Brothers Marketing, LLC ("We," "Us," or "Junk Car Boys"). We reserve the right, at our sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. We may also, in the future offer new services and/or features through the Website. New features will be subject to the terms and conditions of this Agreement.

1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

2. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Junk Car Boys web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

In no event shall Junk Car Boys or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Junk Car Boys's Internet site, even if Junk Car Boys or a Junk Car Boys authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata

The materials appearing on Junk Car Boys web site could include technical, typographical, or photographic errors. Junk Car Boys does not warrant that any of the materials on its web site are accurate, complete, or current. Junk Car Boys may make changes to the materials contained on its web site at any time without notice. Junk Car Boys does not, however, make any commitment to update the materials.

6. Buyer Payments

Our Buyers in our network are responsible for paying for vehicles they have picked up on our behalf by either Check or Credit Card within 7 days after a vehicle has been picked up. Payment by Credit Card: If you choose a direct payment gateway to complete your purchases, your credit card information will be stored in Stripe. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your payment transaction data is stored only as long as is necessary to complete your payment transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a join effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

7. Release of Liability

Should you have a dispute with one of Junk Car Boys Buyers or Carriers, you release Junk Car Boys, it's officers, directors, agents, and employees from all claims, demands and damages of any kind of nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of, or in any way, connected with such disputes.

8. Accuracy of Billing and Account Information

You agree to provide current, complete and accurate purchase and account information for all payment made for vehicles picked up by you. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You authorize Junk Car Boys to use the information you supply to us in connection with our services and in accordance with these Terms.

9. Fees

There are currently no fees for Sellers to use Junk Car Boys. Some Carrier fees may apply to a Buyer when a third party towing service is rendered through Junk Car Boys Buying Team or Website. There are currently no other fees for Buyers to use Junk Car Boys. There are currently no fees for Carriers to use Junk Car Boys.

10. Fraud

Junk Car Boys may suspend or terminate your account, claim or offer if a suspicion arises that you engaged in any fraudulent activity with any vehicles we may have sent you.

11. Links

Junk Car Boys has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Junk Car Boys of the site. Use of any such linked web site is at the user's own risk.

12. Site Terms of Use Modifications

Junk Car Boys may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

13. Governing Law

Any claim relating to Junk Car Boys web site shall be governed by the laws of the State of Washington without regard to its conflict of law provisions. General Terms and Conditions applicable to Use of a Web Site.

14. Indemnification

You hereby agree to indemnify, defend, and hold harmless Junk Car Boys and it's affiliates, officers, employees from any and all loss and damage from and against any and all claims and expenses. Including but not limited to attorney fees, made herein and any other violation of this Agreement and/or any action or relating to this Agreement.
